Privacy Policy

1."Service Provider" respects and protects the privacy of the users and the information that users provide to us will fully. We shall not deliberately disclose your personally identifiable information to any unauthorized third person except where such information shall be disclosed in good faith and for the purpose of law for the time being in force or to protect the rights and property of Service Provider.

Modifications

1.Depending upon the requirement/situations service provider may change, modify, alter, update the terms and conditions of the agreement or features or flow of web portal or adopt a new internet technology without taking the consent of the users.

2."Service Provider" may assign its rights and duties under this agreement to any party at any time without notice to you. Any rights not expressly granted herein are reserved.

General Terms & Conditions

1.It is responsibility of the user to adhere to the minimum system specifications and requirement such as hardware & software as mentioned on the website. Service provider shall not be responsible for non-compliance for above by user.

2.Tenders shall be published by the authorized Tender Inviting Authorities of the government department. We are not responsible for the information provided in the tenders published. In case of any clarifications arising out of the tenders, the users have to contact the respective Tender Inviting Authority.

3.User shall return to the service provider, all written or descriptive matters, documents, tapes or other media, which contain confidential information upon completion or termination of the said agreement.

4.User agrees and acknowledges that he/ she shall be solely responsible for his/ her conduct and that we reserves the right to terminate the rights to use of the Service immediately without giving any prior notice thereof.

5.User can get his account terminated by giving a 30 days advance notice and is not entitled to claim any other compensation for any services to be provided by service provider and the termination is effective from the expiry date of the notice.

6.The web portal may provide links to the third party websites or resources. Service provider has no control over such sites and resources, you acknowledge and agree that we are not responsible for the availability of such external sites or resources, and does not endorse and are not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

7.User authorizes us to verify directly or through third parties, the information provided on the website, including validation against third-party databases. We may also request User for official or government issued evidences to confirm the information provided in certain circumstances or as a prerequisite to customer's needs. User also authorizes to make any inquiries to validate your identity and confirm your ownership of your email address or financial accounts, subject to applicable law. When requested, user shall provide us complete information.

8.The users must ensure that the files being uploaded by them on web portal are free from all kinds of viruses and contain only the relevant information as per the tender documents/ NIT. If it is found that any user have uploaded / attached irrelevant data, bogus or fabricated certificates towards his qualification requirements for a respective tender then their user account shall be liable for termination permanently or temporarily.

9.The Service Provider agrees to grant the user the right to access and use e-Procurement System on the terms & conditions as set out herein and any other terms as may be specified by the government department from time to time.

10.The user also recognizes and acknowledges that the e-Procurement System is being maintained and operated by the Service Provider under an agreement for services executed between the Government and the Service Provider. The user hereby agrees and acknowledges that Service Provider shall not be responsible or liable for any damage or loss resulting from the use of the e-Procurement System.

11.The facility offered by service provider shall be non-transferable and the user shall not assign, resell or commercially exploit the facility for others.

12.In compliance to the Information Technology (Amendment) Act, 2008, the users are hereby directed not to use, display, upload, modify, publish, transmit, update, share or store any information that:

  • belongs to another person;
  • is harmful, threatening, abusive, harassing, blasphemous, objectionable, defamatory, vulgar, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
  • harm minors in any way;
  • infringes any patent, trademark, copyright or other proprietary rights;
  • violates any law for the time being in force;
  • discloses sensitive personal information of other person or to which the user does not have any right to;
  • causes annoyance or inconvenience or deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
  • impersonate another person;
  • contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
  • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.

In case of non-compliance with terms of use of the services and privacy policy Service Provider has the right to immediately terminate the access rights of the users.

13.In the same context, the Service Provider affirms that not to host or publish or edit or store any information or shall not initiate the transmission, select the receiver of transmission, and select or modify the information contained in the transmission.

Governing Law

1.The said agreement is made under and shall be interpreted and governed by the laws applicable in India. The parties irrevocably agree that the courts of Bangalore shall (subject to the paragraph below) have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the jurisdiction of the courts at Bangalore, irrespective of whether Courts/Tribunals in other areas have concurrent or similar jurisdiction.

2.Service Provider reserves the right to initiate any legal action against those bidders violating all the above mentioned terms & conditions of this agreement.
